1. Acceptance of These Terms

By creating an account, linking a child, or otherwise using mylearningshell.com ("My Learning Shell," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the service. These terms apply to all users — parents, guardians, teachers, and the students they manage.

2. Eligibility & Verifiable Parental Consent (COPPA)

My Learning Shell is designed for children in grades K-8. Children under the age of 13 may not register an account on their own. Every child account is created and managed by a verified parent or guardian. Before a child account is activated, the parent must complete Verifiable Parental Consent (VPC) through a $1.00 credit card authorization that is refunded immediately. The transaction record is retained as the COPPA-required consent audit trail. Alternatively, for classroom use, a school administrator may authorize a teacher (via our magic-link attestation flow) to create student accounts directly. Under COPPA's school-consent exception, the school administrator's authorization stands in for parental consent for those students. Each classroom student receives a unique Family Code so a parent can link to the school-enrolled student for read-only viewing. By creating a child account you represent that you are the child's parent or legal guardian and are authorized to consent to the child's use of the service.

3. Accounts & Account Security

Parents and teachers are responsible for maintaining the confidentiality of their login credentials and for all activity that occurs under their account. You agree to notify us immediately of any unauthorized use of your account. Child accounts do not have independent passwords — they are accessed under the parent or teacher account that created them. Parents may generate shareable Review Codes that grant a teacher temporary, read-only access to their child's work; the parent remains responsible for who they share those codes with and may revoke access at any time.

4. Acceptable Use

You agree to use My Learning Shell only for its intended educational purpose. You will not: (a) attempt to circumvent the tutor's Socratic guardrails or extract direct answers through prompt manipulation; (b) upload content that is unlawful, harmful, harassing, or that contains the personal information of others; (c) share accounts or access codes with unauthorized individuals; (d) reverse engineer, scrape, or otherwise disrupt the service. We reserve the right to suspend or terminate access for conduct that violates these terms or that we believe harms the service or its users.

5. Plans, Subscriptions & Billing

My Learning Shell offers a Free plan, a paid Family plan, and a Classroom pilot program. The Free plan requires a one-time $1.00 Verifiable Parental Consent (VPC) charge for parents that is refunded immediately — this is a COPPA child-safety requirement, not a fee. Paid Family plans are billed at the rate displayed on our Pricing page, on the billing cycle you select (monthly or annual). You may cancel a paid subscription at any time; cancellation takes effect at the end of your current billing period and no further charges will be made. We do not provide refunds for partial billing periods. We may change our fees with reasonable advance notice; any change applies only to future billing periods.

6. The AI Tutoring Service ("Professor Shelly")

My Learning Shell provides AI-generated tutoring guidance through a large language model. The tutor is designed to guide students toward answers using the Socratic method and is instructed never to reveal a final answer directly. However, AI-generated content may occasionally be incomplete, inaccurate, or inappropriate. The service is an educational aid, not a substitute for a qualified human teacher, tutor, or (in the case of non-academic concerns) a counselor or trusted adult. Parents and teachers remain responsible for supervising a child's use of the service and for reviewing the guidance it provides.

7. Safety Alerts & Limitation of Counseling

When the AI judges that a student's message indicates distress, bullying, or a request for help beyond schoolwork, it responds with a brief, caring redirect toward a trusted adult and may trigger an automated alert to the child's linked parent or teacher. This is a signal to bring in a real person — it is not professional counseling, crisis intervention, or a guarantee that a concern will be detected. If you believe a child is in danger, contact emergency services directly.

8. Intellectual Property

My Learning Shell, including its curriculum, visual manipulatives, practice games, worksheets, the Professor Shelly mascot, and all related content, is owned by us and protected by intellectual property laws. Content generated by the AI tutor during a session is made available to the student and their linked observers for educational use. You may not copy, redistribute, or commercially exploit service content without our permission.

9. Disclaimers & Limitation of Liability

The service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of or inability to use the service. Our total liability for any claim arising from the service is limited to the amount you paid us in the 12 months preceding the claim (or, for free accounts, to zero dollars). Some jurisdictions do not allow certain liability limitations, so these may not apply to you in full.

10. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will post the revised terms and update the effective date. Continued use of the service after changes take effect constitutes acceptance of the updated terms. The effective date shown below reflects when these Terms were last revised.
